Terms & Conditions ( For Sellers)

1 . Welcome to Localiya.

Localiya (Localiya Digital Marketplace) is located at Mumbai and is operated by Localiya Digital Marketplace. The Localiya provide an app-based market platform to seller with the ability to create his store and sell products in local surrounding and customers with the ability to find various type of multiple stores in the local area. Seller ensures to customers quick, fast reliable delivery/return/refund with the option of self-pickup according to customers comfort. We provide our platform to the kind of sellers like grocery, mobile, electronics, restaurants and multi retailers.

We offer the Localiya Services to the following Terms of Services, specifically including Localiya Privacy Policy and Acceptable Use Policy. If you don’t agree to these Term of Service, you are not authorized to use the Localiya Service. To note, these Terms of Service apply to our partner sellers, customers & service. If we include some additional term for the app we will notify you with the proper channel. Those provisions are incorporated into these Terms of Service.

2. Use of the Localiya platform

a. Information You Provide

Certain feature of the Localiya Service requires registration. If you choose to register, you agree to provide and maintain accurate, current and complete information about yourself. Registration data and personal information about you are governed by our Privacy Policy.

b. Member Account, Password and Security

You are responsible for maintaining the confidentiality of your password and account, if any, and are fully responsible for any and all activities that occur under your password or account. Please immediately notify Localiya to any unauthorized use of your password or account or any other breach of security. Localiya reserve the right to terminate accounts and/or services that are inactive for (six) 6 months or more. 

c. Multiple Store Policies

An individual seller can create only a single account and a single store under his account with his own mobile number and email id. If sellers have more than one store in different location he needs to create another account and store with separate mobile number and email id. If sellers have more than one account and store, later it can be added in the previous account with the option of “Add another account”.

d. Misuse of Seller Account

If you are selling illegal product, or cheating customers, delivering defected products or unable to fulfil your order without informing customers, will be considered as misuse of seller obligation.
Or if you repeatedly upload excessive amounts of data, engage in fraud or other illegal activity, fail to comply with the Terms of Service or any other Localiya policies, or otherwise use the service in an excessive or unreasonable Localiya may, in its sole discretion, cancel your account, suspend your use of Localiya platform, restrict or terminate your account, and/or withhold and disburse any proceeds associated with that account.

e. Social Networking Services

Seller will be asked to link their social profile at the time of store creation. We may also ask you to authenticate, register or log in to those social network services. As part of such integration, the social network service will provide us with the access to certain information that you have provided to such social network services, and we will use, store and disclose such information in accordance with our Privacy Policy.

Please remember that Localiya has no control over the way social networking services use, store and disclose your information. Please review their policy to understand their privacy-related clauses.

f. Promotions

Any promotions related to sales or events etc done through or behalf of Localiya may be governed by specific rules that are in addition to these Term of service. Any such practice will be subject to those rules.

g. Age Requirement

A person must be not younger than 18 years. If you are below 18 years, you are not authorized to use Localiya Seller app.

h. Applicable Law

In connection with your use of the Localiya account, you are bound with all applicable laws, regulations and industry standards.

3. Creating Stores and Listing Products

Localiya seller app allows sellers to signup account, create a store and list products over our platform. Following are some specific rules and regulation concerning the creation of store, listing products, selling the products, and disputes conditions. To the extent any violation these Term of Service, we may choose to terminate or delete account and store in our discretion.

a. Your Right to Create Store

By creating store through Localiya Seller App, you represent and warrant that you own the title, trademark and logo of your store. In some case, if your franchiser or licenser allows you to use their brand, trademark, then you are only liable for its use or misuse. Localiya will be not reasonable of any dispute in future.

b. Acceptable Product

Your use of Localiya seller app including the creation of store and listing of products are subject to these Term of Service (Including our Acceptable Product). The seller can only list legal products, defined by the law of the local administration or government as a salable product through an e-commerce platform. To the extent, if any listed product found violates or is alleged to violate our Acceptable use Policy or any other part of these Term of Service, You agree that Localiya has the right to terminate your account or delist your product immediately.

c. Quality and Genuity

All sellers must list genuine, original, sealed pack and fresh product. Duplicate, used, damaged and tempered can’t be sold under Localiya app. All product listing must have accurate and correct descriptions. If any violation for these Term of Service found Localiya has right to terminate seller account and store. Localiya can also stop and seized your wallet and money immediately. Any loss done to customers will be compensated by this money under applicable law by consumer court.

d. Partnership Disputes

If you work with other people like your partners, franchise, the dispute must be resolve by you and your partner mutual consent or by the rule of the law. Localiya will never intervene in any kind you dispute until and unless it is not related to us. Localiya may withhold payouts until the dispute is resolved. Any dispute arising between seller and customers is out of this Terms of use shall be submitted to the exclusive jurisdiction of the local courts where the seller belongs to or about uses of the Localiya app by the seller and customers shall be submitted to the exclusive jurisdiction of the court at Mumbai. Users agree that the laws of India shall govern these Terms of Use.

e. Customer Disputes

The Seller agrees that it is solely responsible for its interactions (including any purchase and sale transactions), with any other customers in connection with the Service and Localiya (or its service/technology partners) will have no liability or responsibility with respect thereto. Localiya reserves the right but has no obligation, to become involved in any way with disputes between you and any other user of the Service.

Any dispute arising between seller and customers is out of this Terms of use shall be submitted to the exclusive jurisdiction of the local courts where the seller belongs to or about uses of the Localiya app by the seller and customers shall be submitted to the exclusive jurisdiction of the court at Mumbai. Users agree that the laws of India shall govern these Terms of Use.

4. Intellectual Property Complaints

Only sellers who are registered as account and having store, are only bound to follow our terms of uses. Selling duplicate or copied product over Localiya online store is completely prohibited. You can’t sell any copyrighted product without the permission of authorization. Also, you understand that Localiya may release your all information including contact to any third party satisfactorily alleges a violation of its copyrights.

Localiya will consider complaints of possible infringement only from parties that own or have the exclusive right to exploit, the applicable intellectual that own or have the exclusive right to exploit, the applicable intellectual property. If you believe that a Localiya seller has infringed upon your rights, please notify Localiya through the mail.

Terms & Conditions ( For Customers)

1. Purchasing of Products & Services

By purchasing an item the buyer agrees to be bound by the conditions of sale included in the item’s description provided that those conditions of sale are not in breach of this User Agreement or otherwise unlawful. Localiya is not responsible for the side effects one might endure by use of any item bought through the Website.

Localiya recommends the buyer to look for other users’ feedback or rating for each seller’s store and product before placing order. We encourage the buyers to post feedback and rating on the seller’s app home after the order is closed and the product is delivered.

As Localiya is open to all seller platform and also we take necessary and precautionary measures to ensure the seller is genuine but it is unable to confirm and verify the identity of the seller. We always recommend customers to buy products only from the seller you know and trust. Localiya also cannot guarantee the quality, safety or legality of any aspect of the items listed or the accuracy of the listing details. Customers acknowledge the risk while he agrees to our terms and conditions. Localiya suggests and encourages customers to employ common sense. We also advise to contact and report any kind of suspicious, misleading and false claims done by sellers on Localiya app.

a. Payments:

For payments related option please refer to seller payment options on their home screen. Seller will give you the option to choose the payment mode according to how they will accept the order. There will be following payment mode can be available for customers:

• COD (Cash on Delivery)

• UPI

• Credit & Debit Card

• Internet Banking

• UPI

• Wallet

b. Loss and Cancellation

Localiya will be not responsible for any kind of loss or damage of any kind of product. It is advised for all customers to verify the quality and quantity of product before accepting any order. Also, it is recommended for customers to read individual seller’s terms & conditions carefully before placing an order.

c. Returns & Replacements

All kind of return and replacement are subject to seller’s terms and conditions policy. We are not responsible for the return or replacement of the product. it is recommended for customers to read individual seller’s terms & conditions carefully before placing an order.

2. Disclaimer of Warrantee

Localiya is not responsible for warranty and warrantee claim. In most of the cases, warrantee claim fulfilled by the respective brand. Please contact seller for any other warranty related claims. Localiya is not responsible for any warranty claim.

3. Limitation of Liability

Localiya will be not liable for any indirect, incidental, special, consequential, exemplary damages.

4. Termination

Localiya, in its sole direction, may suspend or terminate your account or use of the Localiya Platform and remove and discard any content within the Localiya Platform, for any reason. Further, you agree that Localiya will not be liable to you for any termination of your access to the Localiya Platform.

5. Governing Law

Any dispute arising between seller and customers is out of this Terms of use shall be submitted to the exclusive jurisdiction of the local courts where the seller belongs to or about uses of the Localiya app by the seller and customers shall be submitted to the exclusive jurisdiction of the court at Mumbai. Users agree that the laws of India shall govern these Terms of Use.
